GENERAL CONDITIONS

1. General conditions of purchase

These Specific Terms and Conditions of the Purchase Contract apply to online sales made through the website www.aristocrazy.com (hereinafter, WEBSITE), which is owned by ARISTOCRAZY SA, with registered office at C/ Gran Vía, 40 Bis 3º, 48009 BILBAO, with Tax Identification Number (CIF) A48231146, registered in the Mercantile Registry of Vizcaya in Volume 1959, Folio 170, Page 3970A, Entry 8 (hereinafter, ARISTOCRAZY), TO CUSTOMERS WITH DOMICILES IN SPAIN, ANDORRA, GIBRALTAR, OR PORTUGAL. For sales outside of Spain, Andorra, Gibraltar, and Portugal, the international online sales conditions will apply.

The use of the services offered on the WEBSITE by the customer implies, in all cases, acceptance of these Specific Terms and Conditions of the Online Purchase Agreement, in the version published by ARISTOCRAZY at the time of the purchase order. Therefore, it is advisable that the customer read these Specific Terms and Conditions before making a purchase, as well as the general terms and conditions of use of the portal.

Please also read our Privacy Statement before placing your order. By using this WEBSITE or placing an order through it, you agree to be bound by these Terms and Conditions and our Privacy Statement. If you do not agree to all of the Terms and Conditions and the Privacy Statement, you should not place an order.


2. Subject of the contract

These specific online purchase conditions apply to the purchase of any product on the WEBSITE made by customers whose delivery address is in Spain, Andorra, Gibraltar or Portugal.

The prices for each item of jewelry, watch, accessory, and perfume are listed on the website at the time of ordering. Prices are detailed for each item, including taxes and fees. Shipping costs and any other service charges are also specified and will be itemized for the customer at the time of ordering.

The purchase service through the WEBSITE regulated in these Special Conditions only allows the purchase of products and services to customers over 18 years of age and with a delivery address in Spain, Andorra, Gibraltar or Portugal.

ARISTOCRAZY reserves the right to cancel a customer's access account if fraudulent, speculative or bad faith acts are detected in the use of this service.

ARISTOCRAZY will modify and update, if it deems appropriate, items and prices according to the company's commercial criteria, although the changes will not affect products that have been accepted.

All product orders are subject to availability. If supply difficulties arise, or if items are out of stock, we reserve the right to provide information about substitute products of equal or superior quality and value that the customer may order. If the customer does not wish to order these substitute products, we will refund any amount the customer may have paid.


3. Online purchase process

The information and details contained on this website do not constitute an offer to sell, but rather an invitation to do business. No contract will exist between the customer and ARISTOCRAZY in relation to any product until the order has been expressly accepted by ARISTOCRAZY (even if the customer's account has already been charged). If the offer is not accepted and the customer's account has already been charged, the full amount will be refunded.

To place an order, the customer must follow the online purchase procedure and click on "Place Order." Afterward, they will receive an email acknowledging receipt of their order (Order Confirmation). It should be noted that this does not mean the order has been accepted, as it merely constitutes an offer to ARISTOCRAZY to purchase one or more products. All orders are subject to acceptance by ARISTOCRAZY, which will confirm such acceptance by sending an email informing the customer that the product is being shipped (Shipping Confirmation). The contract for the purchase of a product between ARISTOCRAZY and the customer (Contract) will only be formalized when the Shipping Confirmation, along with the corresponding invoice, is sent to the customer.

Only those products listed in the Shipping Confirmation will be subject to the Contract. ARISTOCRAZY will not be obligated to supply any other products that may have been ordered by the customer until their shipment is confirmed in a separate Shipping Confirmation.

There may even be exceptional circumstances (in accordance with Law 10/2010 of April 28, on the prevention of money laundering and the financing of terrorism) that require us to reject the processing of an order after the Order Confirmation has been sent. ARISTOCRAZY reserves the right to do so at any time, at its sole discretion.


4. Payment methods

The price of the products will be as stated on the WEBSITE at any given time, except in cases of obvious error. Although ARISTOCRAZY strives to ensure that all prices displayed on the WEBSITE are correct, errors may occur. If ARISTOCRAZY discovers an error in the price of products ordered by a customer, ARISTOCRAZY will inform the customer as soon as possible and offer the option of reconfirming the order at the correct price or canceling it. If ARISTOCRAZY is unable to contact the customer, the order will be considered canceled and any amounts paid will be fully refunded.

ARISTOCRAZY is not obliged to supply products (even if the Shipping Confirmation has been sent) if the pricing error is obvious and unambiguous and could reasonably have been recognized by the customer as an incorrect price.

ARISTOCRAZY product prices may vary, but (except as stated above) any changes will not affect orders for which a Shipping Confirmation has already been sent.

Given the nature of online shopping, the product prices displayed on the WEBSITE apply solely to purchases made through the WEBSITE and may not reflect the retail prices at ARISTOCRAZY stores. Therefore, the prices shown on the WEBSITE are binding only for online purchases and do not in any way apply to ARISTOCRAZY stores.

Prices on the website include VAT, but exclude shipping costs, which will be added to the total amount due and itemized for the customer.

Once the customer has finished shopping, all the items they wish to purchase will be added to their bag, and the next step will be to process the order and make the payment. To do this, the customer will follow 6 steps:

  1. You will click on "My Bag" at the top of the page to add the products you wish to purchase.
  2. Next, click on "Buy".
  3. You will fill in and verify your contact information, your order details, the address where you want your order delivered, or the store where you want to pick it up.
  4. You will choose the payment method you wish to use for the purchase (credit card or Paypal) and enter the corresponding information.
  5. You will accept the “Terms and Conditions”
  6. Confirm your purchase by clicking “Place Order”

The customer can pay with Visa, PayPal, in installments through Aplazame (valid exclusively for purchases made with cards issued in Spain), or with a gift voucher. To minimize the risk of unauthorized access, they will be redirected to the virtual payment gateway/PayPal screen to authorize payment for the order.

ARISTOCRAZY uses Verisign to ensure that the payment has been made securely.

Credit cards will be subject to verification and authorization by the issuing entity; if said entity does not authorize the payment, ARISTOCRAZY is not responsible for any delay or lack of delivery and, ultimately, for not proceeding to formalize the sales contract with the customer.

For all orders exceeding €1,000, you must send us a color copy of both sides of your ID card or passport to customersupport@aristocrazy.com , and once the documentation is approved, we will process your order.


Value Added Tax (VAT)

For orders destined for Ceuta and Melilla, deliveries would be exempt from VAT without prejudice to the application of the corresponding taxes and duties in accordance with the regulations in force in each of them.


5. Shipping

All shipments cost €3.95.

Free shipping on orders over €99.

In-store pickup is free with our click and collect service.

Estimated delivery times within the peninsula are 1 to 2 business days from when the order is sent out for delivery (*).

The shipment will be made through a company independent of ARISTOCRAZY, which undertakes to deliver the product paid for by the customer to the delivery address within an approximate timeframe of:

Aristocrazy does not ship to the Canary Islands.

(*) These deadlines may be extended up to 45 days for some of the following reasons:

  • Product customization
  • Special items
  • Unforeseen circumstances not attributable to ARISTOCRAZY
  • Product out of stock

If for any reason we are unable to meet the delivery date, we will inform you of this and you will be given the option to proceed with the purchase by setting a new delivery date or to cancel the order for a full refund. Please note that we do not deliver on Saturdays, Sundays, or public holidays.

For the purposes of these Terms, delivery shall be deemed to have taken place or the product(s) shall be deemed to have been delivered at the time of signing for their receipt at the agreed delivery address.

Online orders picked up in-store will have a delivery time of approximately 3 to 4 business days and will be collected directly from the ARISTOCRAZY stores specified at checkout or order confirmation. In these cases, home delivery will not be available. The product must be collected within 15 days; after this period, the product will be returned to the warehouse and a full refund will be issued.

For all orders exceeding €1,000, you must send us a color copy of both sides of your ID card or passport to customersupport@aristocrazy.com , and once the documentation is approved, we will process your order.

The risks associated with the Products will be borne by the customer from the moment of delivery.

The customer will acquire ownership of the products when full payment of all amounts due in relation to them, including shipping costs, is received.

If customs holds the package, the recipient will be responsible for paying the processing fees. This condition is accepted upon purchase. If the item arrives at its destination and the customer refuses to pay the customs and handling fees, this amount will be deducted from the product refund.

Your order may be shipped from different warehouses. If this happens, we will let you know by email which items you will receive in each shipment.


6. Return

The return period is 30 days.

The customer may return any product free of charge.

Refund to the original payment method: You can request a refund up to 15 days after receiving your order. Once we have it in our warehouse, we will process the refund to the original payment method within a maximum of 15 days.

Online order returns will be processed at Aristocrazy establishments authorized by the company.

Once the withdrawal has been formalized and the item has been returned along with its original packaging, the refund will be processed as soon as possible, and in any case, within fourteen calendar days following the moment when ARISTOCRAZY has been made aware of the customer's withdrawal.

All payments received will be refunded, including delivery costs if applicable. The refund will be issued via the same payment method used for the original purchase.

Under no circumstances will exchanges be accepted for perfumes that have been unsealed after delivery, are not in perfect condition, or have been opened or used, except when the purchased product has some type of flaw or defect.


Withdrawal form

The customer must attach the withdrawal form details to their order; the information it must contain is as follows:

Return to STORE CREDIT (STORE CREDIT)

In cases where the product was purchased as a gift, and the recipient wishes to exchange it, the procedure will be as follows:

Within THIRTY (30) days of receiving the product, the recipient of the gift will contact ARISTOCRAZY at the following address customersupport@aristocrazy.com either Here . At that time, you will provide the order number shown on the delivery note and how you prefer to make the return: you can leave it at any of the ARISTOCRAZY points of sale or you can choose to have it collected from another location.

Once the product arrives at ARISTOCRAZY, an exclusive online gift voucher will be sent via email to the interested party so that they can make a new purchase in the online store within 1 year.


7. Warranty

ARISTOCRAZY offers its customers products and services of the highest quality.

The gold used to manufacture the pieces is 750 thousandths (18 carats), 375 thousandths (9 carats), the silver is 925 thousandths and the platinum is 950 thousandths.

ARISTOCRAZY purchases diamonds directly from their origin. ARISTOCRAZY diamonds come with a GIA certificate and comply with the Kimberley Process (the certification system for international trade in diamonds not originating from conflict zones).

Given the unique characteristics of the products sold by ARISTOCRAZY on its website, slight differences exist between each product or service purchased. This is primarily due to the singularity and exclusivity of each and every material and stone used in their creation, which is also largely handcrafted. Therefore, no two ARISTOCRAZY products or services are exactly alike, and it is inevitable that the product delivered to the customer will differ slightly from the one shown in the photographs included in the website's purchase process (even if it was the same product). Under no circumstances will these differences imply the delivery of products or services with lower quality materials than those expressly stated on the website. Furthermore, the customer is informed and understands that the size of the photographs on the website does not correspond to the actual size of the ARISTOCRAZY products offered.

Therefore, the client is informed and expressly consents to these circumstances and differences, without them being able to be a cause for termination of the Contract.

In any case, without prejudice to the provisions at the beginning of this section, ARISTOCRAZY products purchased by the customer through the purchase procedure established on the WEBSITE have the legal guarantee of consumer goods, that is, their conformity with their description on the WEBSITE and with these Particular Conditions.

ARISTOCRAZY is liable for any lack of conformity that becomes apparent within three years of delivery. The consumer must inform the seller of the lack of conformity within two months of becoming aware of it. Failure to comply with this deadline will not result in the loss of the right to the corresponding remedy; however, the customer will be liable for any damages actually caused by the delay in notification. In any case, the warranty excludes defects caused by improper use, as well as all those excluded by current European Union legislation.


8. Basic care

There are a few simple care tips that will extend the life of your ARISTOCRAZY jewelry. For example, we suggest removing your ARISTOCRAZY jewelry before engaging in activities that could damage it, such as exercising. Try to avoid contact between your ARISTOCRAZY jewelry and cosmetics or household products, as these sometimes contain ingredients that can affect the color of your jewelry.

To clean your jewelry, use the Official Aristocrazy Cloth and check the clasps frequently.

Do not expose ARISTOCRAZY jewelry to sudden temperature changes. For proper preservation, it is best to store your ARISTOCRAZY products individually. If you choose to use a jewelry box, try to keep them in a separate compartment from other pieces. Try to keep chains closed and laid flat to prevent tangling.

9. Customer service

ARISTOCRAZY does not cover the shipping costs to the after-sales service if the warranty has expired.


10. Competent jurisdiction and applicable law

Any dispute arising from this online sales contract shall be subject to the jurisdiction of the Spanish courts. Furthermore, Spanish law (Consolidated Text of the General Law for the Defense of Consumers and Users) shall apply to all matters not expressly provided for in this contract.

The European Commission offers a platform for alternative dispute resolution, which can be accessed from: http://ec.europa.eu/consumers/odr/ ARISTOCRAZY is not affiliated with any association or organization that offers an out-of-court dispute resolution system.

11. Intellectual Property and Property

All content (including graphic design, source code, logos, texts, graphics, illustrations, photographs, trade names, trademarks or distinctive signs and any elements that appear on the WEBSITE), unless expressly stated otherwise, are the exclusive property of ARISTOCRAZY or third parties.

No intellectual or industrial property rights are transferred to the client over the WEBSITE or any of its constituent elements, and the client is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting, reusing, forwarding or using in any way, by any means or procedure, any of them, except in cases where it is legally permitted or authorized by the holder of the corresponding rights.

The client may view and obtain a temporary private copy of the content for their exclusive personal, private, and non-collective use on their computer systems (software and hardware), provided that it is not for the purpose of carrying out collective, commercial, or professional activities. The client must refrain from obtaining, or attempting to obtain, the content by means or procedures other than those made available to them or indicated for that purpose, or those commonly used on the Internet (provided that the latter do not entail a risk of damage to or disablement of the WEBSITE). The client must at all times respect all intellectual and industrial property rights over the WEBSITE, owned by ARISTOCRAZY or third parties.

In any case, ARISTOCRAZY reserves the right to modify, at any time and without prior notice, the presentation and configuration of the WEBSITE, as well as these Particular Conditions.


12. Availability of the online purchase service

The Service will be available 24 hours a day. ARISTOCRAZY informs the buyer that anomalies or interruptions in the availability or operation of the Service may occur due to causes beyond ARISTOCRAZY's control (technical problems of Internet providers, telecommunications, problems with the buyer's terminal, etc.), therefore the purchase period may be extended.


13. Special conditions for the Piercing Studio

To get your piercing with us, you must make an appointment, be at least 16 years old (if you are under 18, you must be accompanied by a parent or legal guardian), and bring your ID on the day of your appointment. Please arrive five minutes before your appointment to complete the necessary consent forms and purchase the jewelry. The piercing does not include changing the jewelry once the piercing has healed or at any other time.

14. Digital Gift Cards

Digital gift cards purchased as a product on the website do not expire. They can be used at any time to purchase products available in the online store, in accordance with these terms and conditions.

Gift cards are non-refundable, interest-free, and cannot be exchanged for cash. The balance can be used in full or in part for one or more purchases until it is depleted.

In the event of unauthorized use of the gift card code, or access to it by third parties for reasons not attributable to ARISTOCRAZY, ARISTOCRAZY will not be responsible for the redemption. The cardholder is responsible for the safekeeping and confidentiality of the code received by email.

This regulation applies exclusively to gift cards purchased as a product on the website, without prejudice to the specific conditions applicable to vouchers or credits issued as a result of returns (store credit), which may be subject to a different validity period as indicated in these General Conditions.
