GENERAL CONDITIONS

1. General purchase conditions

These Specific Purchase Contract Conditions apply to online sales made through the website www.aristocrazy.com (hereinafter, WEBSITE) owned by ARISTOCRAZY S.A., with address at C/ Gran Vía, 40 Bis 3º, 48009 BILBAO, with CIF A48231146, registered in the Mercantile Register of Vizcaya in Volume 1959, Folio 170, Sheet 3970A. 8th registration (hereinafter, ARISTOCRAZY) TO CUSTOMERS WITH ADDRESS IN SPAIN, ANDORRA, GIBRALTAR OR PORTUGAL. For sales outside the national territory, Andorra, Gibraltar and Portugal, the international online sales conditions will apply.

The use by the customer of the services offered on the WEBSITE implies, in any case, the acceptance of these Specific Online Purchase Contract Conditions, in the version published by ARISTOCRAZY, at the very moment of the purchase order. Therefore, it is advisable for the customer to read these Specific Conditions before proceeding with a purchase, as well as the general terms and conditions of use of the portal.

Please also read our Privacy Statement before placing an order. By using this WEBSITE or placing an order through it, the customer agrees to be bound by these Conditions and by our Privacy Statement, so if you do not agree with all the Conditions and the Privacy Statement, you should not place any order.


2. Subject of the contract

These specific online purchase conditions apply to the purchase of any product present on the WEBSITE made by customers whose delivery address is in Spain, Andorra, Gibraltar or Portugal.

The prices of each of the jewelry, watches, accessories and perfumes are indicated on the website on the date of the order. Prices are detailed for each item, including taxes and fees. The amount of shipping costs and any other service is also specified and will be indicated to the customer in a broken down manner at the time of placing the order.

The purchase service through the WEBSITE regulated in these Specific Conditions only allows the purchase of products and services to customers over 18 years of age and with a delivery address in Spain, Andorra, Gibraltar or Portugal.

ARISTOCRAZY reserves the right to cancel a customer's access account if fraudulent, speculative or bad faith acts are detected in the use of this service.

ARISTOCRAZY will modify and update, if deemed appropriate, articles and prices according to the company's commercial criteria, although the changes will not affect products that have been accepted.

All product orders are subject to their availability and, in this regard, if there are difficulties in their supply, or if there are no items in stock, we reserve the right to provide information about substitute products of equal or superior quality and value that the customer may order. If you do not wish to order these substitute products, we will refund any amount you may have paid.


3. Online purchase process

This information and the details contained on the WEBSITE do not constitute an offer to sell, but an invitation to do business. There will be no contract between the customer and ARISTOCRAZY in relation to any product until the order has been expressly accepted by ARISTOCRAZY (even if your account has already been charged). If the offer is not accepted and a charge has already been made to your account, the amount will be fully refunded to the customer.

To place an order, the customer must follow the online purchase procedure and click on "Place order". After this, you will receive an email acknowledging receipt of your order (Order Confirmation). It should be noted that this does not mean that your order has been accepted, as it constitutes a mere offer to ARISTOCRAZY to purchase one or more products. All orders are subject to acceptance by ARISTOCRAZY, which will confirm such acceptance by sending an email stating that the product is being shipped (Shipping Confirmation). The contract for the purchase of a product between ARISTOCRAZY and the customer (Contract) will only be formalized when the Shipping Confirmation with its corresponding invoice is sent to said customer.

Only those products listed in the Shipping Confirmation will be subject to the Contract. ARISTOCRAZY will not be obliged to supply any other product that may have been ordered by the customer until its shipment is confirmed in a separate Shipping Confirmation.

There may even be exceptional circumstances (in accordance with Law 10/2010, of April 28, on the prevention of money laundering and the financing of terrorism) that require the rejection of an order after having sent the Order Confirmation. ARISTOCRAZY reserves the right to do so at any time, at its sole discretion.


4. Payment methods

The price of the products will be that stipulated at all times on the WEBSITE, except in case of manifest error. Although ARISTOCRAZY tries to ensure that all prices listed on the WEBSITE are correct, errors may occur. If ARISTOCRAZY discovers an error in the price of the products that the customer has ordered, ARISTOCRAZY, after informing the customer as soon as possible, will give them the option to reconfirm their order at the correct price or cancel it. If ARISTOCRAZY fails to contact the customer, the order will be considered canceled and any amounts paid will be fully refunded.

ARISTOCRAZY is not obliged to supply products (even if the Shipping Confirmation has been sent) if the price error is obvious and unequivocal and could have been reasonably recognized by the customer as an incorrect price.

ARISTOCRAZY product prices may vary, but (except as stated above) possible changes will not affect orders for which a Shipping Confirmation has already been sent.

Given the particularities of online shopping, the price of the products indicated on the WEBSITE refers solely and exclusively to purchases made on it, without necessarily matching the retail price of ARISTOCRAZY establishments. In accordance with the foregoing, the price indicated on the WEBSITE is only considered binding for online purchases and in no way binds ARISTOCRAZY establishments.

Prices on the website include VAT, but exclude shipping costs, which will be added to the total amount due and will be indicated to the customer in a broken-down manner.

Once the customer has made their purchases, all the items they wish to buy will have been added to their bag and the next step will be to process the order and make the payment. To do this, the customer will follow 6 steps:

  1. Click "My Bag" at the top of the page to add the desired products.
  2. Then click on "Buy".
  3. Fill in and check your contact information, order details, the address where you want your order to be sent or the store for collection.
  4. Choose the payment method you wish to use for the purchase (credit card or Paypal) and enter the corresponding information.
  5. Accept the “Terms and Conditions”
  6. Confirm the purchase by clicking "Place order"

The customer can make the payment with Visa, Paypal, in installments through the financial company Aplazame (valid exclusively for purchases made with cards issued in Spain) or gift voucher. To minimize the risk of unauthorized access, you will be redirected to the virtual payment gateway/Paypal screen which will authorize the payment of the order.

ARISTOCRAZY uses Verisign to ensure that payment has been made securely.

Credit cards will be subject to checks and authorizations by their issuing entity; if said entity does not authorize payment, ARISTOCRAZY is not responsible for any delay or lack of delivery and, ultimately, for not formalizing the sales contract with the customer.

For all orders over €1,000, you must send us a color copy of both sides of your ID card or passport to  customersupport@aristocrazy.com, and once the documentation is approved, we will process your order.


Value Added Tax (VAT)

For orders destined for Ceuta and Melilla, deliveries would be exempt from VAT, without prejudice to the application of the corresponding taxes and duties in accordance with the regulations in force in each of them.


5. Shipping

All shipments have a cost of €4.95.

Free shipping on purchases over €149.

Store pickup is free with our click and collect service.

Estimated shipping times within the peninsula are 1 to 2 business days from when the order goes out for delivery (*).

Shipping will be carried out by a company other than ARISTOCRAZY, which undertakes to deliver the product paid for by the customer to the delivery address within an approximate period of:

Aristocrazy does not ship to the Canary Islands.

(*) These deadlines may be extended up to 45 days for any of the following reasons:

  • Product customization
  • Special items
  • Unforeseen circumstances not attributable to ARISTOCRAZY
  • Product out of stock

If for any reason we are unable to meet the delivery date, we will inform you of this circumstance and the customer will be given the option to continue with the purchase by establishing a new delivery date or to cancel the order with a full refund of the price paid. It should be taken into account in any case that deliveries are not made on Saturdays, Sundays or public holidays.

For the purposes of these Conditions, delivery shall be deemed to have occurred or the product(s) shall be deemed to have been delivered at the time of signing for receipt of the same at the agreed delivery address.

Online order deliveries to stores will have a shipping period of approximately 3 to 4 business days, and will be made directly to the ARISTOCRAZY establishments indicated in the checkout or order confirmation gateway. In these cases, there will be no possibility of choosing delivery to any address. The collection period for the product in these cases will be 15 days; after this period, the product will be returned to the warehouse and the amount will be refunded.

For all orders over €1,000, you must send us a color copy of both sides of your ID card or passport to  customersupport@aristocrazy.com, and once the documentation is approved, we will process your order.

The risks of the Products will be borne by the customer from the moment of their delivery.

The customer will acquire ownership of the products when full payment of all amounts due in relation to them, including shipping costs, is received.

In the event that customs retains the package, the recipient will be responsible for paying the processing costs. This condition is accepted when making the purchase. In the event that the item arrives at its destination and the customer refuses to pay the customs and processing fees, this amount will be deducted from the product refund.

Your order may be shipped from different warehouses. If this occurs, we will let you know by email which items you will receive in each shipment.


6. Returns

The return period is 30 days.

The customer may return any product free of charge.

Refund to the same payment method: You can request it up to 15 days after receiving your order. Once we have it in our warehouse, we will proceed with the refund to the same payment method within a maximum of 15 days.

Online withdrawals made at a store will be processed at Aristocrazy establishments authorized by the brand.

Once the withdrawal has been formalized and the item returned along with its original packaging, the amount will be refunded as soon as possible, and in any case, within fourteen calendar days following the moment ARISTOCRAZY became aware of the customer's withdrawal.

All payments received, including delivery costs if any, will be refunded. The method used for the refund will be the same as the one used for payment.

In no case will exchanges of perfumes that have been unsealed after delivery, are not in perfect condition, or have been opened or used, be accepted, except when the purchased product has some type of defect or flaw.


Withdrawal form

The customer must attach the withdrawal form details with their order; the information it must contain is as follows:

  • I hereby communicate that I withdraw from our sales contract (order details) for the following product(s): (description as it appears on the website)

Return in STORE CREDIT (STORE CREDIT)

In cases where the product has been purchased as a gift, and the recipient wishes to exchange it, the procedure will be as follows:

Within THIRTY (30) days from receipt of the product, the recipient of the gift will contact ARISTOCRAZY at  customersupport@aristocrazy.com or here. At that time, they will provide the order number shown on the delivery note and indicate how they prefer to make the return: they can leave it at any ARISTOCRAZY point of sale or opt for it to be collected elsewhere.

Once the product arrives at ARISTOCRAZY, an exclusive online gift voucher will be sent to the interested party via email so that they can make a new purchase in the online store within 1 year.


7. Warranty

ARISTOCRAZY offers its customers products and services of the highest quality.

The gold used for manufacturing the pieces is 750 thousandths (18 karats) first-grade gold, 375 thousandths (9 karats) first-grade silver, and 925 thousandths first-grade silver and 950 thousandths first-grade platinum.

ARISTOCRAZY purchases diamonds directly at the source. ARISTOCRAZY diamonds come with their GIA certificate and comply with the conditions of the "Kimberley Process" (certification system for the international trade of non-conflict diamonds).

Given the special characteristics of the products marketed by ARISTOCRAZY on its website, there are slight differences between each product or service purchased, mainly due to the uniqueness and exclusivity of each and every one of the materials and stones used in their creation, which is also largely artisanal. Therefore, no two ARISTOCRAZY products or services are exactly alike, and in any case, it is inevitable that the product delivered to the customer will differ slightly from that shown in the photographs included in the website's purchase process (even if it were the same). In no case will these differences imply the delivery of products or services with lower material quality than those expressly mentioned on the Portal. Likewise, the customer is informed and aware that the size of the photographs contained on the Portal does not correspond to the actual size of the ARISTOCRAZY products offered.

Therefore, the client is informed of and expressly consents to these circumstances and differences, without them being a cause for termination of the Contract.

In any case, notwithstanding the provisions at the beginning of the section, ARISTOCRAZY products acquired by the customer through the purchase procedure established on the WEBSITE have the legal guarantee inherent to consumer goods, that is, their conformity with their description on the WEBSITE and with these Particular Conditions.

ARISTOCRAZY is responsible for non-conformities that appear within three years from delivery. The consumer must inform the seller of the non-conformity within two months of becoming aware of it. Failure to comply with this period will not imply the loss of the right to the corresponding remedy, the customer being responsible, however, for any damages or losses actually caused by the delay in communication. In any case, the guarantee relating to defects caused by improper use is excluded, as well as, in general, all those excluded by current European Union legislation.


8. Basic care

There are a number of simple care tips that will extend the life of your ARISTOCRAZY jewelry. For example, we suggest you remove your ARISTOCRAZY jewelry before engaging in activities that could damage it, such as sports. Try to avoid contact between your ARISTOCRAZY jewelry and cosmetic and/or household products, as they sometimes contain ingredients that can damage the color of your jewelry pieces.

To clean your jewelry, use the Official Aristocrazy Chamois and frequently check the clasps.

Do not expose ARISTOCRAZY jewelry to sudden temperature changes. For proper preservation, it is preferable to store your ARISTOCRAZY products individually. If you opt for a jewelry box, try to keep them in a separate compartment from other pieces. Try to keep chains closed and laid flat to prevent knots from forming.

9. Customer Service

ARISTOCRAZY will not cover shipping costs to the after-sales service if the warranty has expired.


10. Competent jurisdiction and applicable law

For any controversy arising from this online sales contract, Spanish courts will be competent. Likewise, Spanish law (Revised Text of the General Law for the Defense of Consumers and Users) will be applicable in everything not provided for in this contract.

The European Commission offers a platform for alternative dispute resolution, which can be accessed from: http://ec.europa.eu/consumers/odr/ ARISTOCRAZY is not affiliated with any association or organization that offers an out-of-court dispute resolution system.

11. Intellectual and property ownership

All content (including graphic design, source code, logos, texts, graphics, illustrations, photographs, trade names, brands or distinctive signs and any elements appearing on the WEBSITE), unless expressly stated otherwise, are the exclusive property of ARISTOCRAZY or third parties.

No intellectual or industrial property right over the WEBSITE or any of its constituent elements is assigned to the customer, and the customer is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting, reusing, re-sending or using any of them, by any means or procedure, unless legally permitted or authorized by the owner of the corresponding rights.

The customer may view and obtain a temporary private copy of the content for their exclusive personal, private, and non-collective use on their computer systems (software and hardware), provided that it is not for the purpose of developing collective activities or commercial or professional activities. The customer must refrain from obtaining, or attempting to obtain, the content by means or procedures other than those made available or indicated for that purpose in each case, or those commonly used on the Internet (provided that the latter do not entail a risk of damage or disabling of the WEBSITE). The customer must at all times respect all intellectual and industrial property rights over the WEBSITE, owned by ARISTOCRAZY or third parties.

In any case, ARISTOCRAZY reserves the right to modify, at any time and without prior notice, the presentation and configuration of the WEBSITE, as well as these Particular Conditions.


12. Availability of the online purchase service

The Service will be permanently available twenty-four 24 hours a day. ARISTOCRAZY informs the buyer that anomalies or interruptions in the availability or operation of the Service may occur due to causes not attributable to ARISTOCRAZY (technical problems of Internet providers, telecommunications, problems with the buyer's terminal, etc.), so the period for making the purchase may be extended.


13. Special Piercing Studio Conditions

To get your piercing with us, you must make an appointment, be at least 16 years old (if you are a minor, you must be accompanied by a parent or legal guardian) and bring your ID on the day you get your piercing. You must arrive five minutes before your appointment to fill out the necessary consent forms for the piercing, and to purchase the jewelry. The piercing does not include changing the jewelry for another one once the perforation has healed or at any other time.

 

14. Digital Gift Cards

Digital gift cards purchased as a product on the website do not have an expiration date. They can be used at any time for the acquisition of products available in the online store, in accordance with these conditions.

Gift cards are not redeemable for cash, do not accrue interest, and cannot be exchanged for money. The balance can be used in whole or in part in one or more purchases until it is exhausted.

In case of unauthorized use of the gift card code, or third-party access to it for reasons not attributable to ARISTOCRAZY, ARISTOCRAZY will not be responsible for the redemption made. The cardholder is responsible for the safekeeping and confidentiality of the code received by email.

This regulation applies exclusively to gift cards purchased as a product on the website, without prejudice to the specific conditions applicable to vouchers or credits issued as a result of returns (store credit), which may be subject to a different validity period as indicated in these General Conditions.
