GENERAL CONDITIONS
1. General conditions of purchase
These Particular Conditions of the Purchase Contract apply to online sales made through the website www.aristocrazy.com (hereinafter, WEBSITE) owned by ARISTOCRAZY SA, with registered office at C/ Gran Vía, 40 Bis 3º, 48009 BILBAO, with CIF A48231146, registered in the Mercantile Registry of Vizcaya in Volume 1959, Folio 170, Sheet 3970A. Entry 8ª (hereinafter, ARISTOCRAZY) TO CUSTOMERS WITH DOMICILE IN SPAIN, ANDORRA, GIBRALTAR OR PORTUGAL. For sales outside the national territory, Andorra, Gibraltar and Portugal, the international online sales conditions will apply.
The customer's use of the services offered on the WEBSITE always presupposes acceptance of these Specific Conditions of the Online Purchase Contract, in the version published by ARISTOCRAZY at the time of the purchase order. Therefore, it is advisable for the customer to read these Specific Conditions before making a purchase, as well as the general terms and conditions of use of the portal.
Please also read our Privacy Statement before placing an order. By using this WEBSITE or placing an order through it, you agree to be bound by these Terms and Conditions and our Privacy Statement. Therefore, if you do not agree with all of these Terms and Conditions and the Privacy Statement, you should not place an order.
2. Purpose of the contract
These specific online purchasing conditions apply to the purchase of any product on the WEBSITE made by customers with a delivery address in Spain, Andorra, Gibraltar, or Portugal.
The prices for each jewelry item, watch, accessory, and perfume are listed on the website at the time the order is placed. Prices are detailed for each item, including taxes and fees. Shipping costs and any other services are also specified and will be itemized for the customer when the order is placed.
The purchase service through the WEBSITE regulated by these Specific Conditions only allows the purchase of products and services to customers over 18 years of age and with a delivery address in Spain, Andorra, Gibraltar, or Portugal.
ARISTOCRAZY reserves the right to cancel a customer's account if fraudulent, speculative, or bad faith acts are detected in the use of this service.
ARISTOCRAZY will modify and update, if it deems appropriate, items and prices in accordance with the company's commercial criteria, although the changes will not affect products that have been accepted.
All product orders are subject to availability. Therefore, if there are supply difficulties or if items are out of stock, we reserve the right to provide information about substitute products of equal or greater quality and value that the customer may order. If the customer does not wish to order these substitute products, we will refund any amount the customer may have paid.
3. Online purchasing process
The information and details contained on the WEBSITE do not constitute an offer to sell, but rather an invitation to do business. No contract will exist between the customer and ARISTOCRAZY in relation to any product until the order has been expressly accepted by ARISTOCRAZY (even if your account has already been charged). If the offer is not accepted and your account has already been charged, the amount will be refunded to the customer in full.
To place an order, the customer must follow the online purchasing procedure and click "Place Order." Afterward, they will receive an email acknowledging receipt of their order (Order Confirmation). Please note that this does not mean that their order has been accepted, as it merely constitutes an offer to ARISTOCRAZY to purchase one or more products. All orders are subject to acceptance by ARISTOCRAZY, which will confirm such acceptance by sending an email informing them that the product has been shipped (Shipping Confirmation). The contract for the purchase of a product between ARISTOCRAZY and the customer (Contract) will only be formalized when the Shipping Confirmation with the corresponding invoice is sent to the customer.
Only those products listed in the Shipping Confirmation will be subject to the Contract. ARISTOCRAZY will not be obligated to supply any other products that may have been ordered by the customer until shipment is confirmed in a separate Shipping Confirmation.
There may even be exceptional circumstances (in accordance with Law 10/2010, of April 28, on the prevention of money laundering and the financing of terrorism) that require us to reject the processing of an order after the Order Confirmation has been sent. ARISTOCRAZY reserves the right to do so at any time, at its sole discretion.
4. Payment methods
The price of the products will be as stipulated at any given time on the WEBSITE, except in the case of obvious errors. Although ARISTOCRAZY attempts to ensure that all prices listed on the WEBSITE are correct, errors may occur. If ARISTOCRAZY discovers an error in the price of the products ordered by the customer, ARISTOCRAZY, after informing the customer as soon as possible, will give them the option of reconfirming their order at the correct price or canceling it. If ARISTOCRAZY is unable to contact the customer, the order will be considered canceled, and any amounts paid will be fully refunded.
ARISTOCRAZY is not obliged to supply products (even if the Shipping Confirmation has been sent) if the pricing error is obvious and unmistakable and could have reasonably been recognized by the customer as an incorrect price.
Prices for ARISTOCRAZY products may vary, but (except as stated above) any changes will not affect orders for which a Shipping Confirmation has already been sent.
Given the specific nature of online purchases, the product prices indicated on the WEBSITE refer solely and exclusively to purchases made therein and are not necessarily the retail price of ARISTOCRAZY stores. Accordingly, the price indicated on the WEBSITE is only binding for online purchases and in no way binds ARISTOCRAZY stores.
The prices on the website include VAT, but exclude shipping costs, which will be added to the total amount due and itemized to the customer.
Once the customer has completed their purchase, all the items they wish to buy will be added to their bag, and the next step is to process the order and make payment. To do so, the customer will follow six steps:
- You'll click on "My Bag" at the top of the page to add the products you want to purchase.
- Next, you will click on "Buy".
- You will fill out and verify the contact information, your order details, the address where you want the order shipped, or the store where you want it picked up.
- You will choose the payment method you wish to use for the purchase (credit card or PayPal) and enter the corresponding information.
- You will accept the “Terms and Conditions”
- Confirm the purchase by clicking “Place order”
Customers can pay with Visa, PayPal, in installments through the financial institution Aplazame (valid exclusively for purchases made with cards issued in Spain), or with a gift voucher. To minimize the risk of unauthorized access, you will be redirected to the virtual payment gateway/Paypal screen, which will authorize payment for the order.
ARISTOCRAZY uses Verisign to ensure that payment is secure.
Credit cards are subject to verification and authorization by the issuing entity; if the entity does not authorize payment, ARISTOCRAZY is not responsible for any delay or non-delivery and, ultimately, for not proceeding to formalize the sales contract with the customer.
For all orders over €1,000, you must send us your ID or passport in color on both sides to customersupport@aristocrazy.com , and once the documentation is in order, we will process your order.
Value Added Tax (VAT)
For orders destined for Ceuta and Melilla, deliveries are exempt from VAT, although the corresponding taxes and tariffs may apply in accordance with the regulations in force in each country.
5. Shipping
All shipments cost €10.95.
Free shipping on purchases over €149.
In-store pickup is free with our click and collect service.
Estimated shipping times within the peninsula are 1 to 2 business days from the time the order is shipped (*).
Shipping will be carried out by a company other than ARISTOCRAZY, which undertakes to deliver the product paid for by the customer to the delivery address within approximately:

Aristocrazy does not ship to the Canary Islands.

If for any reason we are unable to meet the delivery date, we will inform you and give you the option to continue with the purchase by scheduling a new delivery date or cancel the order with a full refund. Please note, however, that deliveries are not made on Saturdays, Sundays, or holidays.
For the purposes of these Conditions, delivery shall be deemed to have taken place or that the product(s) have been delivered at the time of signing for receipt at the agreed delivery address.
Online orders delivered to stores will have a shipping time of approximately 3 to 4 business days and will be made directly to the ARISTOCRAZY stores indicated in the checkout or order confirmation. In these cases, there is no option to opt for shipping to any delivery address. The product collection period in these cases will be 15 days; after this period, the product will be returned to the warehouse and the amount will be refunded.
For all orders over €1,000, you must send us your ID or passport in color on both sides to customersupport@aristocrazy.com , and once the documentation is in order, we will process your order.
The risks of the Products will be borne by the customer from the moment of delivery.
The customer will acquire ownership of the products when full payment of all amounts due in relation to them, including shipping costs, is received.
If customs holds the package, the recipient will be responsible for paying the processing fees. This condition is accepted upon purchase. If the item arrives at its destination and the customer refuses to pay the customs and processing fees, this amount will be deducted from the product refund.
Your order may be shipped from different warehouses. If this occurs, we will notify you by email which items you will receive in each shipment.
6. Return
We've extended the deadline to exchange your Aristocrazy jewelry until January 10th, while the return period will remain at 30 days. Don't wait any longer and experience our Jewel Power.
The customer may return any product free of charge.
Refund using the same payment method: You can request a refund up to 15 days after receiving your order. Once we have it in our warehouse, we will process the refund using the same payment method within a maximum of 15 days.
Deliveries of online returns to stores will be made at authorized Aristocrazy locations.
Once the withdrawal has been formalized and the item has been returned along with its original packaging, the refund will be processed as soon as possible, and in any case, within fourteen calendar days from the moment ARISTOCRAZY has been informed of the customer's withdrawal.
All payments received will be refunded, including any applicable shipping costs. The refund will be processed using the same method used to make the payment.
Under no circumstances will exchanges be accepted for perfumes that have been unsealed after delivery, are not in perfect condition, or have been opened or used, except when the purchased product has some type of defect or flaw.
Withdrawal form
The customer must attach the withdrawal form data to their order, which must contain the following information:

Gift Certificate Return
In cases where the product was purchased as a gift and the recipient wishes to exchange it, the procedure will be as follows:
Before THIRTY (30) days from receipt of the product, the person receiving the gift will contact ARISTOCRAZY through the address customersupport@aristocrazy.com either Here . At that time, you will inform us of the order number on the delivery note and your preferred return method: you can drop it off at any ARISTOCRAZY store or choose to have it picked up elsewhere.
Once the product arrives at ARISTOCRAZY, an exclusive online gift voucher will be sent to the interested party via email so they can make a new purchase in the online store within one year.
7. Warranty
ARISTOCRAZY offers its customers products and services of the highest quality.
The gold used to make the pieces is 750 thousandths (18 carats), 375 thousandths (9 carats), 925 thousandths sterling silver and 950 thousandths sterling platinum.
ARISTOCRAZY purchases diamonds directly from their place of origin. ARISTOCRAZY diamonds are accompanied by their GIA certificate and comply with the conditions of the Kimberley Treaty (a certification system for the international trade of non-conflict diamonds).
Given the special characteristics of the products sold by ARISTOCRAZY on its website, there are slight differences between each product or service purchased, primarily due to the uniqueness and exclusivity of each and every one of the materials and stones used in their production, which is largely handcrafted. Therefore, no two ARISTOCRAZY products or services are exactly the same, and in any case, it is inevitable that the product delivered to the customer will differ slightly from that shown in the photographs included in the purchasing process on the website (even if it were the same). Under no circumstances will these differences result in the delivery of products or services with lower quality materials than those expressly mentioned on the Portal. Furthermore, the customer is informed and aware that the size of the photographs contained on the Portal does not correspond to the actual size of the ARISTOCRAZY products offered.
Therefore, the client is informed and expressly agrees to these circumstances and differences, which cannot be grounds for termination of the Contract.
In any case, without prejudice to the provisions set forth at the beginning of this section, ARISTOCRAZY products purchased by the customer through the purchase procedure established on the WEBSITE have the legal guarantee inherent to consumer goods, that is, their conformity with their description on the WEBSITE and with these Specific Conditions.
ARISTOCRAZY is liable for any lack of conformity that becomes apparent within three years of delivery. The consumer must inform the seller of the lack of conformity within two months of becoming aware of it. Failure to comply with this deadline will not result in the loss of the corresponding right to compensation; however, the customer will be liable for any damages actually caused by the delay in notification. In any case, the warranty for defects caused by improper use is excluded, as is, in general, all those excluded by current European Union legislation.
8. Basic care
There are a number of simple care steps you can take to extend the life of your ARISTOCRAZY jewelry. For example, we suggest removing your ARISTOCRAZY jewelry before engaging in activities that could damage it, such as sports. Try to avoid contact with cosmetic and/or household products, as these sometimes contain ingredients that can damage the color of your jewelry.
To clean your jewelry, wipe it with the Official Aristocrazy Chamois and check the clasps frequently.
Do not expose ARISTOCRAZY jewelry to sudden temperature changes. For proper preservation, it is preferable to store your ARISTOCRAZY products individually. If you choose a jewelry box, try to store them in a separate compartment from other pieces. Try to keep chains closed and laid flat to prevent knots from forming.

9. Customer service

ARISTOCRAZY does not cover the costs of shipping to the after-sales service if the warranty has expired.
10. Competent jurisdiction and applicable law
The Spanish courts shall have jurisdiction over any dispute arising from this online sales contract. Spanish law (the Revised Text of the General Law for the Defense of Consumers and Users) shall also apply to all matters not covered by this contract.
The European Commission offers a platform for alternative dispute resolution, which can be accessed from: http://ec.europa.eu/consumers/odr/ ARISTOCRAZY is not affiliated with any association or organization that offers an extrajudicial dispute resolution system.
11. Intellectual and property property
All content (including graphic design, source code, logos, texts, graphics, illustrations, photographs, trade names, trademarks or distinctive signs and any elements appearing on the WEBSITE), unless expressly indicated otherwise, are the exclusive property of ARISTOCRAZY or third parties.
No intellectual or industrial property rights over the WEBSITE or any of its constituent elements are transferred to the client, and the client is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting, reusing, forwarding or using any of them in any way, by any means or procedure, except in cases where it is legally permitted or authorized by the owner of the corresponding rights.
The client may view and obtain a temporary private copy of the contents for their exclusive personal, private, and non-collective use on their computer systems (software and hardware), provided that this is not for the purpose of carrying out collective activities or of a commercial or professional nature. The client must refrain from obtaining, or attempting to obtain, the contents by means or procedures other than those made available or indicated for this purpose in each case, or those commonly used on the Internet (provided that the latter do not entail a risk of damage or disablement of the WEBSITE). The client must at all times respect all intellectual and industrial property rights over the WEBSITE, owned by ARISTOCRAZY or third parties.
In any case, ARISTOCRAZY reserves the right to modify, at any time and without prior notice, the presentation and configuration of the WEBSITE, as well as these Specific Conditions.
12. Availability of the online purchasing service
The Service will be available 24 hours a day, 7 days a week. ARISTOCRAZY informs the buyer that there may be anomalies or interruptions in the availability or operation of the Service due to causes not attributable to ARISTOCRAZY (technical problems with Internet providers, telecommunications, problems with the buyer's device, etc.), so the purchase process may be extended.
13. Special conditions Piercing Studio
To get your piercing with us, you must make an appointment, be at least 16 years old (if you're a minor, you must be accompanied by a parent or legal guardian), and bring your ID on the day of your piercing. You must arrive five minutes early to your appointment so we can fill out the necessary consent forms for your piercing and purchase the jewelry. The piercing does not include the possibility of exchanging the jewelry for another one once the piercing has healed, or at any other time.
