GENERAL CONDITIONS

1. General conditions of purchase

The present Particular Conditions of the Purchase Contract apply to online sales made through the website www.aristocrazy.com (hereinafter, WEBSITE) whose ownership corresponds to ARISTOCRAZY S.A., with address at C/ Gran Vía, 40 Bis 3º, 48009 BILBAO, with CIF A48231146, registered in the Mercantile Register of Vizcaya in Volume 1959, Folio 170, Page 3970A. Inscription 8ª (hereinafter ARISTOCRAZY) TO CUSTOMERS WITH ADDRESS IN SPAIN, ANDORRA, GIBRALTAR OR PORTUGAL . For sales outside the national territory, Andorra, Gibraltar and Portugal will apply the conditions of international online sales.

The use by the customer of the services offered on the WEBSITE presupposes, in any case, the acceptance of these Special Conditions of the online Purchase Contract, in the version published by ARISTOCRAZY, at the time of the purchase order. Therefore, it is advisable for the customer to read these Particular Conditions before proceeding to make a purchase, as well as the general terms and conditions of use of the portal.

Please also read our Privacy Statement before placing an order. By using this WEBSITE or placing an order through this WEBSITE, you agree to be bound by these Terms and Conditions and our Privacy Statement, so if you do not agree to all of the Terms and Conditions and the Privacy Statement, you should not place an order.


2. Object of the contract

These particular conditions of online purchase apply to the purchase of any product present on the WEBSITE made by customers whose delivery address is in Spain, Andorra, Gibraltar or Portugal.

The prices of each of the jewelry, watches, accessories and perfumes are indicated on the website on the date the order is placed. The prices are detailed in each article including taxes and fees. The amount of shipping costs and any other service is also specified and will be indicated to the customer in detail at the time of placing the order.

The purchase service through the WEBSITE regulated in these Special Conditions only allows the purchase of products and services to customers over 18 years of age and with delivery address in Spain, Andorra, Gibraltar or Portugal.

ARISTOCRAZY reserves the right to cancel a customer's access account if fraudulent, speculative or bad faith acts are detected in the use of this service.

ARISTOCRAZY will modify and update, if deemed appropriate, articles and prices according to the company's commercial criteria, although the changes will not affect the products that have been accepted.

All orders for products are subject to availability and, in this regard, if there are difficulties in supply, or if there are no items left in stock, we reserve the right to provide information about substitute products of equal or superior quality and value that the customer may order. If you do not wish to order such substitute products, we will refund any amount you may have paid.


3. Online purchase process

The present information and details contained in the WEBSITE do not constitute an offer to sell, but an invitation to do business. No contract shall exist between the customer and ARISTOCRAZY in relation to any product until the order has been expressly accepted by ARISTOCRAZY (even if your account has already been debited). If the offer is not accepted and the customer's account has already been debited, the amount will be refunded to the customer in full.

To place an order, the customer must follow the online purchase procedure and click on "Place Order". After this, he/she will receive an e-mail acknowledging receipt of his/her order (Order Confirmation). Please note that this does not mean that your order has been accepted, as the order is merely an offer to ARISTOCRAZY to purchase one or more products. All orders are subject to acceptance by ARISTOCRAZY which will confirm such acceptance by sending an email informing that the product is being shipped (Shipping Confirmation). The contract for the purchase of a product between ARISTOCRAZY and the customer (Contract) will be formalized only when the Shipping Confirmation with its corresponding invoice is sent to the customer.

Only those products listed in the Shipping Confirmation will be subject to the Contract. ARISTOCRAZY shall not be obliged to supply any other products which may have been ordered by the customer until the shipment of the same has been confirmed in a separate Shipping Confirmation.

There may even be exceptional circumstances (in accordance with Law 10/2010 of 28 April 2010 on the prevention of money laundering and the financing of terrorism) that make it necessary to refuse to process an order after the Order Confirmation has been sent. ARISTOCRAZY reserves the right to do so at any time, at its sole discretion.


4. Methods of payment

The price of the products will be that which is stipulated at any given time on the WEBSITE, except in the case of manifest error. Although ARISTOCRAZY tries to ensure that all prices shown on the WEBSITE are correct, errors may occur. If ARISTOCRAZY discovers an error in the price of the products ordered by the customer, ARISTOCRAZY, after informing the customer as soon as possible, will give him the option of reconfirming his order at the correct price or cancelling it. If ARISTOCRAZY is unable to contact the customer, the order will be considered cancelled and the amounts paid will be fully refunded.

ARISTOCRAZY is not obliged to supply products (even if the Shipping Confirmation has been sent) if the pricing error is obvious and unambiguous and could have been reasonably recognized by the customer as an incorrect price.

Prices of ARISTOCRAZY products may vary, but (except as stated above) any changes will not affect orders for which a Shipping Confirmation has already been sent.

Given the particularities of online shopping, the price of the products indicated on the WEBSITE refers solely and exclusively to purchases made on the WEBSITE, and does not necessarily coincide with the retail price of ARISTOCRAZY establishments. In accordance with the above, the price indicated on the WEBSITE is only considered binding for online purchases and in no way binds the ARISTOCRAZY establishments.

The prices on the website include VAT, but exclude shipping costs, which will be added to the total amount due and will be indicated to the customer in an itemized form.

Once the customer has made his purchases, all the items he wishes to buy will have been added to his bag and the next step will be to process the order and make the payment. To do this the customer will follow 6 steps:

  1. You will click on "My Bag" at the top of the page to add the products you wish to purchase.
  2. Then click on "Buy".
  3. You will fill in and check the contact information, the details of your order, the address to which you want the order to be sent or the store where you want it to be picked up.
  4. Choose the payment method you wish to use to make the purchase (credit card or Paypal) and enter the corresponding information.
  5. Accept the "Terms and Conditions".
  6. Confirm the purchase by clicking "Checkout".

The customer may pay by Visa card, Paypal, in installments through the financial company Aplazame (valid only for purchases made with cards issued in Spain) or gift vouchers. To minimize the risk of unauthorized access, you will be redirected to the virtual payment gateway/Paypal screen that will authorize the payment of the order.

ARISTOCRAZY uses Verisign to ensure that the payment has been made securely.

Credit cards will be subject to checks and authorizations by the credit card issuer; if the credit card issuer does not authorize payment, ARISTOCRAZY cannot be held responsible for any delay or non-delivery and, ultimately, for not proceeding to formalize the sales contract with the customer.

For all orders over 1.000€, you must send us your ID card or passport in color on both sides to customersupport@aristocrazy.com, and once the documentation is in order, we will process your order.


Value added tax (VAT)

In accordance with the regulations in force, any purchase made through the Web site shall be subject to Value Added Tax (VAT), which shall be charged at the rate in force at the time of deliver.

In orders destined for Ceuta and Melilla, deliveries would be exempt from VAT without prejudice to the application of taxes and duties in accordance with the regulations in force in each of them.


5. Shipping

All shipments cost 6,95 €.

Free shipping on purchases over 119 €.

Store pickup is free with our click and collect service.

Shipping will be made through the company FedEx, a third party of ARISTOCRAZY, which undertakes to deliver the product that the customer has purchased to the delivery address. In general, the delivery time will be:

  • 5 to 9 days for shipments to the EU (including Iceland, Norway and Switzerland)
  • 7 to 10 days for shipments to all other European countries outside the EU
  • 15 days for shipments to the rest of the world

(*) These deadlines may be extended up to 45 days for any of the following reasons:

  • Product customization
  • Special items
  • Unforeseen circumstances not attributable to ARISTOCRAZY
  • Product out of stock

If for any reason we are unable to meet the delivery date, we will inform you of this circumstance and the customer will be given the option to go ahead with the purchase by setting a new delivery date or cancel the order with a full refund of the price paid. It should be noted in any case that we do not deliver on Saturdays, Sundays or holidays.

For the purposes of these Conditions, delivery shall be deemed to have taken place or the product(s) to have been delivered at the time of signing for receipt thereof at the agreed delivery address.

Deliveries of online orders in store will have a delivery time of between 3 and 4 working days, approximately, and will be made directly in ARISTOCRAZY establishments that are determined in the check out or order confirmation gateway. In these cases there will not be the possibility of choosing to send to any delivery address. The deadline for collection of the product in these cases will be 15 days; after this period the product will be returned to the warehouse and the amount will be refunded.

For all orders over 1.000€, you must send us your ID card or passport in color on both sides to customersupport@aristocrazy.com, and once the documentation is in order, we will process your order.

The risks of the Products shall be borne by the customer from the time of delivery.

The customer shall acquire ownership of the products when full payment of all amounts due in connection therewith, including shipping costs, is received.

In the event that customs holds the package, the recipient will be responsible for paying the processing costs. This condition is accepted at the time of purchase. In the event that the item arrives at its destination and the customer refuses to pay the customs and processing fees, this amount will be deducted from the return of the product.

It is possible that your order will be shipped from different warehouses. If this happens we will let you know by email which parts you will receive in each shipment.


6. Return

Refund using the same payment method: You can request it up to 15 days after receiving your order, send it to our warehouse: Distribuidora Simó (AR). Calle Lapurdi 1, Polígono Industrial de Leguizamón. 48450, Etxebarri, Euskadi. Request the labels via email to customersupport@aristocrazy.com. Once we have it in our warehouse, we will proceed to refund you using the same payment method within a maximum period of 15 days.

Deliveries of online withdrawals in store will be made to Aristocrazy establishments authorized by the firm.

Once the withdrawal has been formalized and the item has been returned along with its original packaging, the amount will be refunded as soon as possible, and in any case, within fourteen calendar days following the moment in which ARISTOCRAZY has become aware of the customer's withdrawal.

All payments received will be refunded, including delivery costs, if applicable. The method used for the return will be the same as the one used for payment.

Under no circumstances will exchanges be accepted for perfumes that have been unsealed after delivery, are not in perfect condition or have been opened or used, except when the purchased product has some type of defect or flaw.


Cancellation form

The customer must attach the data of the withdrawal form with his order, the information it must contain is as follows:

Return on Gift Certificate

In those cases in which the product has been purchased as a gift, and the person receiving the gift wishes to change it, the procedure will be as follows:

Within THIRTY (30) days from receipt of the product, the person receiving the gift shall contact ARISTOCRAZY at customersupport@aristocrazy.com or here At that moment he/she will inform the order number that appears on the delivery note and the way in which he/she prefers to return the product: he/she can leave it at any of the ARISTOCRAZY points of sale or he/she can choose to have it picked up at another place.

Once the product arrives at ARISTOCRAZY, an exclusive online gift voucher will be sent via email to the interested party so that he/she can make a new purchase in the online store within 1 year.


7. Warranty

ARISTOCRAZY offers its customers products and services of the highest quality.

The gold used for the manufacture of the pieces is of 750 thousandths (18 carats), 375 thousandths (9 carats), silver of 925 thousandths and platinum of 950 thousandths.

ARISTOCRAZY buys diamonds directly at the place of origin. ARISTOCRAZY diamonds are accompanied by their GIA certificate and comply with the conditions of the "Kimberley Treaty" (certification scheme for the international trade of diamonds not originating from conflict countries).

Given the special characteristics of the products marketed by ARISTOCRAZY on its website, there are slight differences between each product or service purchased, mainly due to the uniqueness and exclusivity of each and every one of the materials and stones used in its manufacture, which is also, to a large extent, handmade. Therefore, no two ARISTOCRAZY products or services are exactly alike and, in any case, it is inevitable that the product delivered to the client differs slightly from the one shown in the photographs included in the purchase process of the website (even if it had been the same). In no case, these differences will imply the delivery of products or services with worse quality of materials than those expressly mentioned in the Portal. Likewise, the client is informed and is aware that the size of the photographs contained in the Portal does not correspond to the actual size of the ARISTOCRAZY products offered.

Therefore, the customer is informed and expressly consents to these circumstances and differences, without them being a cause for termination of the Contract.

In any case, without prejudice to what is established at the beginning of this section, the ARISTOCRAZY products acquired by the customer through the purchase procedure established on the WEBSITE have the legal guarantee proper to consumer goods, that is, their conformity with their description on the WEBSITE and with these Particular Conditions.

ARISTOCRAZY is liable for any lack of conformity which becomes apparent within three years of delivery. The consumer must inform the seller of the lack of conformity within two months of becoming aware of it. Failure to comply with this deadline will not entail the loss of the right to the corresponding remedy, the customer being responsible, however, for the damages or losses actually caused by the delay in communication. In any case, the guarantee related to those damages caused by an inadequate use is excluded, as well as in general all those excluded by the legislation of the European Union in force.


8. Basic care

There are a number of simple care steps that will extend the life of your ARISTOCRAZY jewelry. For example, we suggest that you remove your ARISTOCRAZY jewelry before engaging in activities that could damage it, such as sports. Try to avoid contact of your ARISTOCRAZY jewelry with cosmetic and/or household products, as they sometimes contain some ingredients that may damage the color of your jewelry pieces.

For cleaning, wipe your jewelry with the Official Aristocrazy Chamois and check the clasps frequently.

Do not expose ARISTOCRAZY jewelry to sudden changes in temperature. For proper conservation, it is preferable to store your ARISTOCRAZY products individually. If you opt for a jewelry box, try to keep them in a separate compartment from other pieces. Try to keep the chains closed and laid flat to avoid the formation of knots.

9. Customer Services

ARISTOCRAZY does not bear the cost of shipping to the after-sales service in the event that the warranty has expired.


10. Jurisdiction and applicable law

For any dispute arising from this online sales contract shall be competent Spanish courts. Likewise, Spanish law (Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios) shall be applicable in all matters not provided for in this contract.

The European Commission offers a platform for alternative dispute resolution, which can be accessed at: http://ec.europa.eu/consumers/odr/ARISTOCRAZY is not a member of any association or organization offering an out-of-court dispute resolution system.


11. Intellectual property and property

All contents (including graphic design, source code, logos, text, graphics, illustrations, photographs, trade names, trademarks or distinctive signs and any other elements appearing on the WEBSITE), unless expressly stated otherwise, are the exclusive property of ARISTOCRAZY or third parties.

No intellectual or industrial property rights over the WEBSITE or any of its integral elements are transferred to the client, and the reproduction, transformation, distribution, public communication, making available, extraction, reuse, resending or use of any nature, by any means or procedure, of any of them is expressly forbidden to the client, except in cases where it is legally permitted or authorized by the owner of the corresponding rights.

The customer may view and obtain a temporary private copy of the contents for his exclusive personal, private and non-collective use on his computer systems (software and hardware), provided that it is not for the purpose of developing collective activities or of a commercial or professional nature. The customer must refrain from obtaining, or attempting to obtain, the contents by means or procedures other than those that in each case have been made available or indicated for that purpose or those commonly used on the Internet (provided that the latter do not involve a risk of damage or disablement of the WEBSITE). The customer must at all times respect all intellectual and industrial property rights on the WEBSITE, owned by ARISTOCRAZY or third parties.

In any case, ARISTOCRAZY reserves the right to modify, at any time and without prior notice, the presentation and configuration of the WEBSITE, as well as these Particular Conditions.


12. Availability of the online purchase service

The Service will be permanently available twenty-four hours a day, twenty-four hours a day. ARISTOCRAZY informs the buyer that there may be anomalies or interruptions in the availability or operation of the Service due to causes not attributable to ARISTOCRAZY (technical problems of Internet providers, telecommunications, problems in the buyer's terminal, etc.), so that the time to make the purchase may be extended.


13. Special conditions for Piercing Studio

To get your piercing done with us you must make an appointment, be at least 16 years old (if you are a minor you must be accompanied by a parent or legal guardian) and bring your ID the day you are going to get your piercing done. You should arrive five minutes before your appointment in order to fill out the necessary consents to have the piercing done, and to purchase the jewelry. The piercing does not include the exchange of the jewelry for another once the piercing has healed or at any other time.
